Proposed Legislation

No child shall be taken into custody of SRS, nor shall any child be declared a Child In Need of Care (CINC), unless (A) all legal parents or guardians are (1) incarcerated, (2) deceased, or (3) missing and not locatable via a Federal Bureau of Investigations missing persons search; or unless (B) all legal parents and guardians are in free and uncoerced agreement that the child should be taken into custody or declared a CINC.

If any parent or guardian is not incarcerated, deceased, missing, or freely consenting, then their child shall not be taken into SRS custody or declared a CINC and that parent shall be permitted, unhindered, to raise their child in the manner of all other law-abiding citizens of the State of Kansas. Once a child properly and legally comes into the custody of the state, existing parental rights will immediately be terminated and a permanent adoptive home will be found for the child as soon as possible.

Should a child come into custody of SRS or be declared a CINC mistakenly while one or more legal parents or guardians are not consenting, not incarcerated, and not deceased; or should a parent or guardian who was previously missing be found; or should an incarcerated parent be found innocent; then upon discovery of the mistake, if it is within two years of the date of the child coming into custody, full custody of the child shall be given immediately to said parent or guardian, and any adoption shall be rendered null and void, unless said parent or guardian has since become (and remains) freely consenting, or incarcerated, or deceased.

This legislation shall not be intended to require that children be declared CINCs and be taken into SRS custody if all parents are deceased, missing, incarcerated, or freely consenting. Rather, this shall be understood as a prohibition against doing so in any other circumstance.

Reasons this is Necessary

From 2002 through 2008, approximately 80% of children that have been declared CINCs and have been taken into custody by the State of Kansas have at least one parent who is not consenting, not incarcerated, not missing, and not deceased. These parents, since they are not incarcerated, are law-abiding citizens. These law-abiding citizens are forcibly forbidden from raising their own children at great taxpayer expense.

From 2002 through 2008, approximately 3% of children that have been declared CINCs and have been taken into custody by the State of Kansas are, after an average 23 months (almost 2 years) in state homes, returned to their parents, only to come back into state custody again later. These children's lives are turned upside down repeatedly and unnecessarily at great taxpayer expense.
